
BENTON – Marshall County Fiscal Court met in regular session Monday, July 11, 2016.
In Old Business, the Road Resolution Review Committee recommended that the Fiscal Court change interpretations and amendments to the March 7, 2006 that establishes the requirements for roads to be adopted into the county maintenance system.
Under New Roads, the subgrade must lay for one year after gravel has been applied if not compacted to acceptable limits. Under Existing Roads, a road must have been in existence for 15 years with a surface aggregate or concrete easily traversed and supporting traffic for the entire 15 year period. A minimum of two residences or business must be in existence for the 15 year period and meet an average of one per quarter mile as well as qualifying residences or businesses that must use the road to gain access to a residence of business. The changes were approved by the court.
Board Appointment
Fairdealing Olive Fire Department received one letter submitted by Ken Azarela to the Landowner position on the board which the court approved.
Nuisance Ordinance
A 17-page nuisance ordinance statute set by the State Legislature to be adopted for Marshall County and the City of Hardin with areas that can be adapted to fit the needs of the county, was read by Assistant County Attorney Jason Darnall.
The Ordinance #2016-07 will replace what the county currently has in effect to deal with complaints on nuisance properties. The county must adopt the ordinance or have no ordinance at all under the new regulatory scheme.
All court members agreed the old way of taking care of nuisance properties was not effective and recognize that no matter what they do there will be a cost to the county with very little in return in the way of collecting money for the expense of the clean up.
Discussion among court members revolved around what constitutes a nuisance and will an enforcement officer identify nuisances or by written complaint only.
NEW BUSINESS
Hospital Board
The court approved the re-appointment of Kenneth Shadowen to the Hospital Board and appointed Jeff Smith to replace Teddy Kinsey who has reached his term limit.
Bid Advertisement
The court will advertise for bids for the Electronic Document Management System which would get as many Fiscal Court documents on line as possible. Judge/Executive Kevin Neal cited a recent example with the recent storm damage with an app created by Andy Lepisto in IT. Pictures were taken of damage in the area and uploaded through the app immediately to the state office with latitude and longitude of each location which made the process of identifying the level of damage readily available.
Road Resolution
The Fiscal Court approved the Road Resolution agreement between the Kentucky Transportation Cabinet and Marshall County to perform resurfacing on various county roads to not exceed the amount of $253,873. Approval of the Resolution was tabled.
Fats, Oils and Grease Ordinance
Ordinance #2016-08 related to Fats, Oils and Grease (FOG) Management Program 1st reading was accepted. The Division of Water suggests the county enter into a Fats, Oil and Grease Ordinance which is enforced by the Health Department. The Ordinance relates to the accumulation of fats, oil and grease into the collection system, sewer lines and pump stations.
Board Appointment
The court approved the re-appointment of Terry Strict to the Possum Trot/Sharpe Fire District Board.
Russell York
The court presented retiring Road Department Superintendent Russell York with a plaque honoring his 37 years with the Road Department and wished him the best in his retirement.
The next meeting of the Fiscal Court is Tuesday, August 2, 2016.
